Informed consent

If you purchase a product or request a service from The Gene Company Limited ("TGC")  ("TGC Services") you will be asked to provide personal health information and a DNA sample.  This information will be stored by TGC or one of its affiliates and DNA will be extracted from your sample to generate genetic data that includes information about genes and other factors relevant to the product or service provided.

 

TGC Services provides insights to enable you to understand your genetic profile and the impact that this may have on a range of aspects of your life including potential nutrient needs or deficiencies, cognitive features, aging profile and other health insights.

TGC Services are based on currently available information in medical and scientific databases that may change or be updated in the future which may impact the TGC Services.

TGC Services are not a diagnosis or treatment and are intended to be for educational purposes only to enable you to work with a medical professional to consider other aspects (such as lifestyle, diet and other factors) before making any changes to your lifestyle.  TGC nor its affiliates shall have no liability of any kind to any person or entity from the use of TGC Services.

Your privacy is important to us and TGC and its affiliates will take reasonable steps to ensure that your data and personal health information will be kept safe and only available to TGC or its affiliates.

By using TGC Services you agree that you are at least 18 years of age, all the information you have provided is true and correct, and you consent to TGC using your information to provide TGC services and agree that TGC has provided you with all the information you need to make an informed decision.

Privacy

TGC is committed to its obligations under the Privacy Act 2020, the Health Information Privacy Code 2020 and to protecting your information, handling it responsibly and securing it with the necessary measures and safeguards. TGC understands that information relating to your health and wellbeing is private and sensitive. All personal information you provide to us is treated as confidential.

 

TGC Partners with MyGene Pty Limited (MG) in Australia and by using TGC products you agree to their terms and conditions.  These can be found at www.mygene.com.au

 

Your DNA sample and data will be stored securely and TGC will never share your data without your consent.

 

Our analysis is limited to the genetic markers we report on and cannot determine your personal risk of disease without the participation of a medical professional who must take into account a wide range of other factors.

 

TGC will generally collect the following information (“Information”):

  • Information you share directly with us for registration e.g. date of birth, full name, credit card details

  • Self-reported health information such as weight goals, family history, blood test data etc

  • Genetic information from DNA testing

  • Information from third parties lawfully provided to us

 

TGC will use this information to provide our services and improve on our services.  This includes sending you product emails or notifications to your verified contact details.

 

Whenever there is a material change to this Privacy Policy a notice will be posted on our website for 30 days at which point changes will become effective. Terms and Conditions

Introduction

These Terms of Service ("Terms") are the terms and conditions which apply to your purchase and use of The Gene Company's products and services ("TGC Services").  By purchasing or using any TGC Service, you agree to be bound by these Terms until terminated by TGC.

The term “TGC” is used in these Terms to mean The Gene Company and its affiliates including MyGene. All products involving MyGene are subject to their terms and conditions that can be found here: www.mygene.com.au

The Terms are subject to change at any time and users are responsible for reviewing the most recent version.

 

Age requirement

TGC Services are only available to people over the age of 16 years unless you have the consent of a parent or guardian.

If you are under the age of 16 years you may not use TGC Services unless TGC receives prior consent of your parent or guardian.  By using TGC Services, you warrant that you are at least 16 years of age and have the right, authority and capacity to enter into these Terms.

Personal Educational only

TGC Services are for education purposes only. TGC Services are not medical advice.

TGC does not guarantee the effectiveness of any insights from a TGC Service. TGC Services are in part based on 3rd party products that use scientific research and your genetic sample to provide insights.  Research is constantly changing and only a portion of all your genetic markers are used.  Regularly updated the platform may change in its output at any time.  Before applying any insights from a TGC Service, you should discuss them with a medical professional. 

You may only use TGC Services for yourself unless explicitly disclosed to, and approved by, TGC.

Process

If you purchase a product from The Gene Company that includes a kit that you must return to The Gene Company, you must return the kit within 1 month of receiving it. The kit will be sent to a third party for processing to extract your genetic information. Your genetic information will then be uploaded to a The Gene Company or third party platform details.

Access to the platform will be provided to you as agreed by the TGC product purchased only after all relevant fees have been delivered in clear funds to TGC. You acknowledge that TGC may stop providing access to the platform at any time and that it is your responsibility to have the required software or applications to access the platform.

 

We recommend carefully considering the implications before sharing any of the insights with other people. TGC may use genetic information from its customers to assist in research purposes.

Agreements and acknowledgements

By buying or using a TGC product or service you agree and acknowledge that:

  • No medical advice is provided by TGC or any representative of TGC at any time.  

  • You are using the product or service at your own sole risk

  • Your genetic sample will be processed, stored, and used by third parties. TGC is not responsible or liable in any way for how that information is stored or used. 

  • You have truthfully disclosed all relevant information requested by TGC including all relevant health and medical information.

  • TGC Services are in part based on 3rd party products that use scientific research and your genetic sample to provide insights.  Research is constantly changing.   Updates of the platform may change its output at any time.All information provided by The Gene Company is for educational purposes only and is not medical advice.

  • You certify that the sample provided is your own

  • You warrant that you do not represent an insurance company nor are you trying to gain information on who to insure.

  • TGC and/or its affiliates will record and store your personal information

  • TGC and/or its affiliates may use your genetic information to assist in research purposes.

  • You will not seek to use, steal or appropriate any intellectual property of TGC or its affiliates. 

  • You will indemnify and hold TGC and its affiliates harmless against any losses you or any other party may suffer from your use of any TGC Service.

  • You will be responsible and must maintain appropriate security for your login credentials

  • You agree to TGC’s privacy policy

  • You will not use any TGC product for any commercial use or any unlawful purpose or for any purpose other than personal education 

  • Your DNA sample can not be returned to you 

  • TGC may terminate provision of its Services to you for any reason at any time

  • TGC's liability to you for any claim you may have against TGC is limited to the purchase price paid by you for the TGC Service.

  • TGC does not warrant that the TGC Service purchased by you will meet your requirements; be accurate, reliable and error free, or will be uninterrupted

  • TGC may make changes to these Terms at any time. It is your responsibility to regularly access our website to check for updates.

Entire agreement

These Terms represent the entire agreement between you and TGC

Waiver

 TGC’s failure to exercise or enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. 

 

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
